Information about inheritance.

Consular Posts of Ukraine provide protection of the rights and interests to the citizens of Ukraine in solving of issues concerning inheritance accordingly the legislation of Ukraine:

1. Civil Code of Ukraine (the official text of the code with all alternations and amendments of 01.02.99 has been published in the bulletin of the Ministry of Justice No.1 of 1999).

2. Consular Statute of Ukraine, Articles 36-38. 51-53.

3. Law of Ukraine on Notary (published in "Bulletin of the Verkhovna Rada" 1993, No.39, Article 383).

4. "Instruction of Notary procedure...", approved by the Order of the Ministry of Justice of Ukraine No.22/5 dating 25.08.94, published in the bulletin of legislation and juridical practice of Ukraine No.5 1998.

Common provisions on the inheritance law are set forth in the Chapter VII of the Civil Code.

Consular department protects inheritance rights of the Ukrainian citizens provided by the legislation of the state where the legacy opened and also by the provisions of the Articles 524-537 of the Civil Code of Ukraine. If there is no relevant norms law regulations or noncompliance with the legislation of the country where the legacy opened and legislation of Ukraine the complications in considering of issues on opened legacy arrival are possible correspondent succession cases are possible.

The Consular Department or the Consular Posts of Ukraine abroad consider the succession questions in favor of Ukrainian citizens, if the following information is provided:

1. Information about the deviser:

1.1. Full name (write all family names, which this person had);

1.2. Date ( day, month and year) of registration the decease;

1.3. Citizenship;

1.4. The last place of the permanent residence;

1.5. Other information, which may be important to search the devisees.

2. Information about the devisees:

2.1. Full name (write all family names, which this person had);

2.2. Relationship, conjugal ties or other relations with the deviser;

2.3. Citizenship;

2.4. The place of permanent residence;

2.5. Actual place of residence at the moment of receiving the information about the inheritance.

3. Information about the legacy itself:

3.1. Time and place of the opening the legacy;

3.2. Availability or non-availability of the testament;

3.3. Of what the legacy consists (real estate or chattels real as well as money on deposit and other savings including bank accounts, securities etc.);

3.4. Location of the real estate if it is included to the legacy.

4. Information about the person who informed about inheritance, and other persons administering the legacy:

4.1. Full name (for natural person);

4.2. Place of employment, post;

4.3. Address, phone and fax number, E-mail;

4.4. The relation to the open legacy

4.5. Addresses, phones and faxes numbers of the persons and legal entities administering the legacy (administrator, executive etc.);

4.6. Peculiarities of the legislation on inheritance of the state where the legacy opened.

Upon reception the information about the open legacy in the form of money savings on bank accounts the additional information about the corresponding bank should be indicated: name, numbers of account, place and time of making the corresponding deposit.

Consular Department and Consular Posts of Ukraine abroad can regard other information appeared during the considering the succession case. According to the Article 36 of the Consular Statute of Ukraine "Consul takes measures for protection of the property remained after death of the citizen of Ukraine".

The assistance in solving succession problems abroad and searching the successors can also be rendered by bars of Ukrainian foreign bar association "Ukrinyurkolegiya".
